March 25, 2022 Dear Brain Gyverne Agwilang, Thank you for your request dated Mar 09, 2022 03:49:19 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Work Break Rule/Policy. The Labor Code of the Philippines as renumbered is replete with provisions on work break rules. Article 85 of the Code espoused for 60 minutes not compensable meal break and two (2) five (5) to twenty (20) minutes compensable rest period. This is separate from the lactation break of the Breastfeeding Code. While these rest periods are mandatory requirements of the law, this does not preclude the establishment to provide additional rest periods. Respectfully, Mark Valeros FOI Receiving Officer
