Thank you for your request dated March 9, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You requested for a copy/sample of unsolicited proposals submitted to our Office, particularly those which relate to “water projects”. Response to your request While our aim is to provide information whenever possible, in this instance, this Office does not have a sample unsolicited proposal for a water project. Further, we are also unable to provide copies of or information on unsolicited proposals actually submitted to our Office because it falls under the Inventory of Exceptions to Executive Order No. 02 (s. 2016) in the Memorandum from the Executive Secretary dated November 24, 2016, to wit: “5. Information, documents or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards, or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers, such as but not limited to the following: a. Trade secrets, intellectual property, business, commercial, financial and other proprietary information;” Your right to request review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Office of the Executive Director. Your review request should explain why you are dissatisfied with this response and should be made within 15 working days from the date you received this letter. We will complete the review and tell you the result within 30 working days from the date we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the Secretary of the National Economic and Development Authority and thereafter, to the Office of the President pursuant to Administrative Order No. 22 (s. 2011).
