February 27, 2023 Dear Ms. De Guzman: Greetings! Thank you for your request dated Feb 24, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for TIN Verification and BIR Form 2316. Response to your request In reply, please be informed of the following: a.) TIN Verification Request - After careful consideration, we resolve to deny your request due to the following reasons: The request falls outside the scope of the FOI program (i.e. the request is a front-line/government service of the agency, etc.); and TIN and Other Relevant Personal Information is considered a piece of Sensitive Personal Information that is bounded by the Data Privacy Act of 2012, as such, it is not advisable to be uploaded in the FOI Portal because this is a public website. TIN Inquiry and/or Validation are now available through Chatbot-Revie which can be accessed thru the BIR Website (www.bir.gov.ph). b.) BIR Form 2316 for Taxable Year 2017 - Your request for a copy of your BIR Form 2316 for the Taxable Year 2017 cannot be granted by the Revenue District Office (RDO) since the aforesaid BIR Withholding Tax Certificates were issued in 2017 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008). Hence, you may ask your previous employer for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
