No.: FRO-2023-1227-13 Dear Ms. Zarate: This refers to your request under Executive Order No. 2 (s. 2016) on Freedom of Information (FOI) in the Executive Branch which we received on 23 December 2023, through the eFOI portal (www.foi.gov.ph) with Ticket Reference No. #TAPI-425142311888. In your FOI request, you would to like to request for a copy of the documentary video of Smith Valley Agriculture Cooperative (SVAC) entitled “This Land is Ours” which was shown during the “LUNDUYAN” event held last 02 October 2023 at the Podium Hall, Mandaluyong. The Technology Application and Promotion Institute of the Department of Science and Technology (DOST-TAPI) was created by virtue of Executive Order No. 128 on 30 January 1987 and is one of DOST's service agencies whose primary responsibility is to promote the commercialization of technologies and market the services of other operating units of the Department. On 28 April 1992, DOST-TAPI's function was expanded by virtue of Republic Act No. 7459, otherwise known as the "Inventors and Invention Incentives Act of the Philippines". While our aim is to provide information whenever possible, we regret that your request was DENIED since there was an earlier request from you dated 12 December 2023 regarding the same and a Conforme Letter was sent to you to ensure the proper distribution, in compliance with agency copyright protocols, and maximize impact strategically, and granting your request to have a copy of the documentary for the exclusive viewing of your clan and cooperative members, with the understanding that DOST-TAPI holds the exclusive right to carry out, authorize or prevent the following acts, subject to limitations stipulated by law: 1. Any reproduction of the work or a substantial portion of it. 2. The transformation of the work in any form, including but not limited to dramatization, translation, adaptation, abridgment, arrangement, or any other transformative process. 3. The first public distribution of the original and each copy of the work by sale or any other forms of transfer of ownership. 4. Rental of the original or a copy of the audio-visual or cinematographic work, a work embodied in a sound recording, a computer program, a compilation of data and other materials, or a musical work in graphic form, irrespective of the ownership of the original or the copy. 5. Public display of the original or a copy of the work. 6. Public performance of the work. 7. Any other form of communication to the public of the work, including uploading in any social media or mass viewing platform. In addition, we informed you that no fees shall be collected for viewing the documentary, and no part of the documentary may be reproduced, copied, or recorded on any device. Nevertheless, there are related videos that were already uploaded on DOST-TAPI Official Facebook Page on 31 July 2023 and on DZRH Official FB Live Radyo Hednyo on 20 August 2023 that you may show to your clan and/or cooperative members while waiting for the access to the requested documentary.
