I'm currently working on a media report regarding sexual offences committed by foreigners in South East Asia, and I was wondering if you could provide me with the following information:
- The number of foreigners (i.e. non Filipino citizens) accused of committing sexual offences in the Philippines since January 2009
- The number of foreigners charged with committing sexual offences in the Philippines since January 2014.
- The number of foreigners convicted in the Philippines for committing sexual offences since January 2014.

Your Request
You asked from the Department of Justice (DOJ), for media report purpose, the following information:
1. the number of foreigners charged for sexual offenses in the Philippines from 2009 up to present; and
2. the number of foreigners convicted for sexual offenses in the Philippines since January 2019
Response to Request
Your FOI request is approved.
The term sexual offenses include the crimes of rape, sexual assault, prostitution, trafficking, and other forms of sexual violence and abuse.
Due to this complexity, this Office cannot provide you with all the data requested since the procurement thereof will require action beyond our mandate.
Although citizens are afforded the right to information and, pursuant thereto, are entitled to "access to official records," the Constitution does not accord them a right to compel custodians of official records to prepare lists, abstracts, summaries and the like in their desire to acquire information on matters of public concern. (Valmonte v. Belmonte, G.R. No. 74930 February 13, 1989)
However, this Office, in the exercise of reasonable diligence, has made the necessary consultation with the Inter-Agency Council Against Trafficking (IACAT), this Department, with respect to cases of trafficking.
Enclosed herewith are Tables providing some of the data requested.
Your right to request a review
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Hon. Menardo I. Guevarra, Secretary of the DOJ. Your review request should explain why you are dissatisfied with this response, and should be made within fifteen (15) calendar days from the date when you received this letter.
