March 30, 2023 Dear Ms. Moya: Greetings! Thank you for your request dated Mar 26, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for The Copy of Income Tax Return. Response to your request In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Calendar Year/s 2010 to 2023. Please be informed that your request cannot be granted by the Revenue District Office (RDO) since the aforesaid BIR Withholding Tax Certificates (BIR Form 2316) were issued in 2010 to 2017 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008). Hence with due diligence, you may coordinate fully with your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because All Taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019. If you already have a TIN, you may get your TIN Card at the Revenue District Office (RDO) that issued your TIN (where you are registered). Bring at least two (2) valid IDs as proof of your identity, and one (1) piece 1x1 latest ID picture. Physical appearance of taxpayer is required. Authorized representative is not allowed, except for special cases approved by the RDO (ex., Senior Citizens or Persons with Disabilities). TIN Inquiry and/or Validation are now available through Chatbot-Revie which can be accessed thru the BIR Website (www.bir.gov.ph). Thank you.
