October 4, 2021 Dear Jabes Lazaro, Greetings! This respectfully pertains to your eFOI request regarding the Statement of Assets, Liabilities, and Net Worth of Secretary Arthur P. Tugade with tracking no. #DOTr-879349148749. Pursuant to the State policy to full disclosure, subject to reasonable conditions prescribed by law and the Constitutional right of people to information on matters of public concern, Executive Order No. 2, series of 2016 ("E.O. No. 2"). was issued ordering the access of every Filipino to information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development. The right to access to information is however limited and shall be denied when the information falls under any of the exceptions enshrined in the Constitution, existing law or jurisprudence. Relative thereto, an Inventory of Exceptions was issued by the Office of the President for the guidance of all government offices and instrumentalities covered by E.O. No. 2 and the general public. The list is without prejudice to existing laws, jurisprudence, rules or regulations authorizing the disclosure of the excepted information upon satisfaction of certain conditions in certain cases. In relation thereto, please be informed that the SALN of members of cabinet, such as Secretary Arthur P. Tugade, are filed with the Office of the President (OP). As such, the Department does not have a copy of the requested information. Accordingly, requests for the abovementioned SALN are best addressed to the proper repository agency, in this case the OP.
