The HoPE did not approve the BAC's award recommendation, verbally. No written decision was issued, only until after several months. Only then, the post-qualified bidder was informed. Despite the non-issuance of the Notice of Award, the bidder filed a complaint citing the said section - "If no action on the contract is taken...within the periods specified....., the contract concerned shall be deemed approved" and is still insisting even after the lapse of the bid validity period. Is the agency obliged to award this contract? Is the bidder's interpretation of the said Section correct?
