June 1, 2023 Dear Eric Ziem, Greetings! Thank you for your request dated May 09, 2023 07:48:06 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your Request You asked for Seaplane Start-places. Response to Request Your FOI request is approved. I enclose a copy all of the information you requested. The following should be secured prior to the application for an Air Operator Certification (AOC): 1. Local Government Permit 2. Philippine Maritime Authority Permit/Certificate 3. Philippine Coast Guard Permit/Certificate 4. Certificate of Public Convenience and Necessity (CPCN) from Civil Aeronautics Board (CAB) After all the above documents are met, below is the requirements of this Authority as specified on Philippine Civil Aviation Regulations: 9.1.1.6 ISSUANCE OR DENIAL OF AIR OPERATOR CERTIFICATE (a) The Authority may issue an AOC if, after investigation, the Authority finds that the applicant: (1) Is a citizen of the Republic of the Philippines; (2) Has its principal place of business and its registered office, if any, located in Republic of the Philippines; (3) Meets the applicable regulations and standards for the holder of an AOC; (4) Has at least three (3) aircraft, one (1) of which must be owned by the applicant. The aircraft ownership requirement does not apply to existing AOC holder that meets one of the following: (i) Owned at least one (1) aircraft for a period of one (1) year from the issuance of the original Air Operator Certificate; (ii) Engaged in commercial air operations for ten (10) consecutive years from the issuance of the original Air Operator Certificate; (iii) Currently leasing at least five (5) Philippine-registered aircraft; or (iv) Has a paid-up Capital of at least Five Hundred Million (P500,000,000.00) Pesos for International Air Operators and Fifty Million (P50,000,000.00) Pesos for Domestic Air Taxi Operators. (5) Is properly and adequately equipped for safe operations in commercial air transport and maintenance of the aircraft; and (6) Holds the economic authority issued by the Republic of the Philippines under the provisions of the Civil Aviation Law. (b) The Authority may deny application for an AOC if the Authority finds that: (1) The applicant is not properly or adequately equipped or is not able to conduct safe operations in commercial air transport; (2) The applicant previously held an AOC which was revoked; (3) The applicant fails to comply with the required number of aircraft; or (4) An individual that contributed to the circumstances causing the revocation process of an AOC obtains a substantial ownership or is employed in a position required by this regulation. (c) The issue of an AOC by the Authority shall be dependent upon the operator demonstrating an adequate organization, method of control and supervision of flight operations, training program as well as ground handling and maintenance arrangements consistent with the nature and extent of the operations specified. (d) The continued validity of an AOC or equivalent document shall depend upon the maintaining the requirements of paragraph (c) above under the supervision of the Authority.
