Your Request
You asked for Rules and Regulations in Establishing Waste-to-Energy facilities in the Philippines.
Response to Request
We wish to provide you the following information on WTE technologies:
Republic Act (RA) 9513 or the “Renewable Energy Act of 2008” is a landmark law enacted to promote the development, utilization, and commercialization of indigenous renewable energy (RE) resources in the country. Pursuant to Section 30 of RA 9513, the Department encourages the adoption of WTE facilities in coordination with the Department of Environment and Natural Resources. The Department also issued Department Circular (DC) No. DC 2022-02-0002 otherwise known as “Prescribing the Policies and Programs to Promote and Enhance the Development of Biomass Waste-to-Energy (WTE) Facilities” to facilitate the promotion of WTE.
Meanwhile, the development of RE resources including WTE technologies is governed by the current guidelines, DC No. DC2019-10-0013, otherwise known as the “Omnibus Guidelines Governing the Award and Administration of Renewable Energy Contracts and the Registration of Renewable Energy Developers”. Said DC and other renewable energy-related issuances may be downloaded from the Department's website (www.doe.gov.ph).
Furthermore, the Department of Environment and Natural Resources (DENR) issued DENR Administrative Order (DAO) No. DAO-2019-21, otherwise known as the “Guidelines Governing Waste-To-Energy (WtE) Facilities for the Integrated Management of Municipal Solid Wastes”, provides guidelines on the evaluation, establishment, operation, and de-commissioning of WTE Facilities utilizing municipal solid wastes (MSW).
Lastly, Senators Sherwin T. Gatchalian, Francis N. Tolentino, and Ramon B. Revilla Jr. introduced Senate Bill (SB) Nos 151,177, and 989, respectively, which are legislative measures on the application of WTE technologies in the country, and the same shall establish a national energy policy and regulatory framework for facilities utilizing WTE technologies.
