I MARIEL MANUEL,I RESIGNED ON JUL.15,2020 DUE TO PREGNANCY.MY PREVIOUSED EMPLOYER IS RBCP.I WNT TO KNOW IF I HVE D RIGTHS TO GET MY SALARY HOLDED BY MY EMPLOYER,SINCE IT'S BEEN 3 MO.LONG.AS MY EMPLOYER PROTOCOL I NEED TO WAIT 1 MO.BEFORE TO SIGN MY CLEARANCE & SUCESFULY WAITED& SIGNATORIES IN BRANCH OFFICE WAS SUCCESSFULLY DONE.1 OF SIGNATORIES IN HEAD OFFICE WAS DONE IN 14 DAY QUARANTINE.I CAN'T GO EVERYTIME TO THE HEAD OFFICE TO SIGN THE CLEARANCE DUE TO LOCK OF MONEY .EVEN THOUGH I TOLD THEM PLEASE TO SIGN MY CLEARANCE OR THEIRS ANOTHER SOLUTION CAUSE I NEED MY SALARY FOR MY PREMATURE BABY.

October 26, 2020 Dear MARIEL MANUEL, Greetings! Thank you for your request dated Oct 24, 2020 11:34:27 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your Request You asked for RIGTHS OF EMPLOYEES (with regard to payment of backpay). The Labor Code of the Philippines stands as the law governing employment practices and labor relations in the country. It contains several provisions which are beneficial to labor. Pursuant to its provisions, the DOLE issued Labor Advisory No. 6 series of 2020 "Guidelines on the Payment of Final Pay and issuance of Certificate of Employment," requires employers to release the final pay of workers within one (1) month of separation from service for whatever reason unless there is a more favorable company policy or CBA. Further, any issue or claim dispute arising out or relating to the payment of final pay must be filed before the DOLE Regional/Provincial/ or Field Office having jurisdiction to the workplace.
