Nagkaroon po ng mass temporary lay-off ang aming company kaya yung iba po ay nag reklamo, kaya po nag rebranding ang company namin from REAL CONNECT to ART CORP BPO.
Kamakailan lang po ay nagpadala ang company ng letter samin na sinasabing tanggapin daw po namin yung pag transfer samin sa ibang field, kami po ay pumasok sa company bilang Encoder at dahil nga po nagkaroon ng mass temporary lay-off gusto po kaming ilipat sa field ng live call, alam naman po nilang hindi namin kaya na mag live call kaya po expected nila na hindi namin tatanggapin ang offer nila.

Questions
Kung mag voluntary resignation po kami ngayon, pwede pa rin po ba kaming makasuhan ng insubordination?
At kapag resigned na po kami pwede po ba kaming humingi ng separation pay sa employer dahil nga po mayroong mass temporary lay-off kaya gusto kaming ilipat sa ibang field kaya kami napilitang mag resign, kung hindi naman po ibigay pati yung ibang benefits, matutulungan nyo po ba kami gamit ang CONSTRUCTIVE DISMISSAL?

Dear DANBERT DOMINGO,
Magandang araw po.
Ayon po sa inyong E-SEnA na natapos noong November 8, 2023, kayo po ay nagkasundo na noong kayo po ay napaliwanagan ukol sa inyong
Floated Status. Ang extent lang po ng floating status ay 6 months. During that period kayo po ay hahanapan ng bagong post ng inyong employer. Kung hindi po kayo mahahanapan ng job post within that time period, saka pa lang po kayo magiging entitled sa separation pay.
Ang separation pay po ay binibigay lamang kapag ang empleyado ay tinanggal sa trabaho for authorized causes - walang nagawang kasalanan ang empleyado subalit kailangan pa rin siyang tanggalin. Samakatwid po, ang pagre-resign po ay hindi nagme-merit ng separation pay.
Uulitin po namin na ang schedule of work, ang place of work, ang paraan, at kung papano ninyo gagampanan ang inyong trabaho ay prerogative ng inyong employer. Noong kayo'y tumanggi sa pang-gabing shift, sa trabahong may live calls, pwede na pong maging grounds iyon para sa insubordination.
Ang definition po ng constructive dismissal ay ang deliberate na pagpapahirap ng employer sa kanilang working condition with the intention to force employees to resign. Sa aming pagkaka-alam sa BPO industry, dependent po ang inyong trabaho sa availability ng kliyente o account na may encoding job order. Marahil hindi po kasalanan ng inyong employer na mawalan sila ng account na may encoding job-order - dahilan po marahil ng inyong pagkakafloating status. Sa makatwid, hindi po makokonsiderang deliberate o sinasadya ng employer ninyo ang hirap na inyong dinadanas ngayon.
