Greetings!
Thank you for your request dated Dec 27, 2022 11:09:12 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
Your Request
You asked for the following documents: BIR Form 2316 (Year 2020 or 2021), BIR Form 1902, BIR Form 1904 and Tin Verification Slip.
Response to Request
We been calling your mobile number today, December 28, to validate your existing eFOI request, however, it was unsuccessful.
In reply, please be informed of the following response to your requests, to wit:
A.) BIR Form 2316 (Year 2020 and 2021) - please be informed that BIR Form 2316 must be accomplished by your EMPLOYER for each employee receiving salaries, wages, and other forms of remuneration, indicating the total amount paid and the taxes withheld for the calendar year. It must be issued to the employee on or before Jan. 31 of the succeeding year, or on the day of last payment of wages in case of termination from employment. This certificate, will serve as your ITR being an employee earning purely compensation income regardless of the amount. You are qualified to “Substituted Filing” of ITR pursuant to Revenue Regulation (RR) No. 2-98 as amended.
Kindly coordinate with your EMPLOYER and ask for the copy of said BIR Form from year 2021, if you have not received a copy.
B.) BIR Form 1902 and BIR Form 1904 - Both are available and accessible for download at the BIR Website (www.bir.gov.ph).
C.) TIN Verification Slip - TIN and Other Relevant Personal Information is considered a piece of Sensitive Personal Information that is bounded by the Data Privacy Act of 2012, as such, it is not advisable to be uploaded in the FOI Portal because this is a public website.
In relation to this, you may do either of the following:
You may visit the nearest BIR Revenue District Office (RDO) on your request. Please bring two (2) valid government-issued I.D.s containing the photograph and signature as proof of your identity for validation purpose. Addresses and contact numbers of RDOs can be found in the BIR Website at www.bir.gov.ph homepage/contact us/directory/revenue district offices links.
If the request is made through representative, a Special Power of Attorney of the requesting party (principal) and at least two (2) valid government IDs containing the photograph and signature of the representative and the principal shall be presented.
You may also adopt Other Measures to ensure that Section 270 of the 1997 Tax Code, as amended, and Republic Act 10173 are not violated.
You are highly advised to utilized the Enhanced BIR Digital Assistant-Chatbot REVIE (www.bir.gov.ph). The said app now include TIN Verification/Validation, RDO Finder and eComplaint Facility.
