Hi! A copy of my BIR 2316 Form (Certificate of Compensation Payment/Tax Withheld) for the calendar year 2022 is something I would want to request. This is due to the fact that it fulfills one of my new employer's requirements. I've already asked my former employer for a copy of my BIR 2316, but they haven't gotten back to me via email. July 28, 2022 Dear James Nicko Banlaygas, Greetings! Thank you for your request dated Jul 15, 2022 10:30:35 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Requesting of BIR 2316. Response to your request Per initial evaluation from Internal Revenue Integrated System (IRIS) , it was found that your TIN: 751-376-984-00000 is registered under RDO54A – Trece Martirez City, East Cavite and you are only registered as Executive Order No. 98-Filipino Citizen and not registered as a Local Employee; You also submitted only one proof of identification not in compliance with the eFOI requirement. In addition, Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the employer to furnish the employee his BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made. This office gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2023. Please be informed that you have the right to appeal the decision of the undersigned with fifteen (15) days from receipt of this Notice of Denial. For your further guidance, please refer to the Revised People’s Freedom of Information Manual for the Bureau of Internal Revenue, circularized through Revenue Memorandum Circular No. 14-2022, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
