Hello, Good Day. I would like to request a copy of SARO-BMB-C-22-0012004. I came across the same request with tracking #OVP-624372148363, however, no copy of SARO-BMB-C-22-0012004 was released. Instead, the requester was just referred to the list of SARO on the DBM website. To clarify, I would to request copy of the "CONTENT" of SARO-BMB-C-22-0012004. If ever this information cannot be released through this channel, kindly advise on how should I proceed in order for me to obtain such copy. Thank you.

December 21, 2023 Dear JEHEDAIAH MINGUITO, Greetings! Thank you for your request dated Nov 08, 2023 11:24:08 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Request for the ACTUAL CONTENT of SARO-BMB-C-22-0012004. At the outset, please be informed that there are pending cases involving the Office of the Vice-President confidential fund filed before the Supreme Court, of which the requested SARO is included as among the documents related thereto. Moreover, we have noted that based on sub judice rule, documents containing information pertaining to matters under litigation are listed as one of the FOI exceptions. Thus, the DBM may not provide copies of SAROs pertaining to matters under litigation as the same fall under the FOI exceptions in the DBM FOI Manual. If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Secretary Amenah F. Pangandaman at [email protected]. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.
