Good day! Last March 28, 2022, while driving going to Manila, I accidentally bumped V1's car. We immediately went to the police station to have it reported. Our settlement is that my insurance will be used for the repair of damages of V1's car. However, our insurance company discovered that V1's car last registration date is 2018. With this, the claim was denied. Am I still responsible to repair his car given he violated the law and our settlement is to use my insurance? Thank you!

You asked for Reporting of car w/ expired registration involved in a car accident.

Response to your request

Please be informed that a vehicular accident which resulted in damage to property, falls within the jurisdiction of the regular courts, as contemplated by the pertinent provisions of Executive Order No. 266, s. 1987, specifically Section 3 (a) thereof, which reads:

“Section 3. The Traffic Adjudication Service shall have the following powers and functions:
 
To hear and decide cases involving of laws, rule and regulations governing land transportation and imposes fines and/or penalties Therefore, provided that the violations resulting in damage to property and/ or physical injuries or violations constituting offenses punishable under the Revised Penal Code or other penal laws shall be under the jurisdiction of the regular courts”  (Underlining supplied)

In this regard, we cannot act favorably on your request. You are advised to file your complaint before a Court that has jurisdiction on the matter. Rest assured that this Office will follow whatever the Court will order with regard to the administrative aspect of the case.
