May 4, 2017 Dear Ramil Joselito Tamayo, I refer to my letter of May 03, 2017 12:39:12 PM; about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Regional Airport Projects Documents. Our response to your request is due on May 24, 2017 12:39:12 PM. Unfortunately, it is taking longer than expected to deal with your request. We are currently coordinating with our Legal Dept., Aviation Group, and the PPP Center. We apologize for this delay but have applied for an extension so we could work further on your request. June 2, 2017 Dear Ramil Joselito Tamayo, Greetings! Thank you for your request dated May 03, 2017 12:39:12 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. After review by the DOTr Legal Department, we regret to inform you that your request has been denied. According to our Legal team: "After review, we are of the opinion that the request of Mr. Tamayo should not be given due course as the same is not in accordance with procedures laid down in the Executive Order (EO) 2. Section 9 of EO 2 provides the person requesting access to information shall, among others, state the reason or purpose of the request for information. This was not clearly indicated in the letter request of Mr. Tamayo. Be that as it may, from his letter, it can be inferred that Mr. Tamayo is requesting for documents relating to the recently unbundled Airport Development Projects for the Bacolod-Silay, Davao, Iloilo, Laguindingan, and New Bohol Airports. However, we find his request to be moot and academic as the same has been over taken by the recent decision of the Pre-Qualifications Bids and Awards Committee. With this recent change of policy direction in the procurement of these projects, we find it futile to consider the request of Mr. Tamayo because as of to date, there are no more PPP projects to speak of. The requested documents are now irrelevant, since the Department, in pursuing these projects under a different mode of procurement, would have to go again through the process, such as, conducting feasibility study and seeking approvals of other government agencies. Granting his request might lead to confusion to the public and interested bidders that this Department is still pursuing these projects under PPP."
