The Public-Private Partnership (PPP) Center said that they proposed for the amendment of the build-operate-transfer (BOT) law, which could include a tariff-setting feature, is currently being prepared for submission to Congress. The key features of the proposed measure : * Deleting unnecessary requirements that could hamper the fast-tracking of projects * Good governance mechanisms , particularly in ensuring competition in the process * Transparency mechanisms * Contracts disclosures * Enhancement of the unsolicited proposals framework
* Some “vague” rules in the existing BOT law (definition of direct subsidy equity or guarantee) * Institutionalization of the good practices that have been experienced under the program for the last 20 years If it's possible to have a draft proposal of the PPP center's proposal for the amendment of BOT law. Thank you for your request dated 04 June 2020 under Executive Order No. 2 (s. 2016) on Freedom of Information (FOI) in the Executive Branch. Your request You asked for the draft Public Private Partnership (PPP) Center proposal for the amendment of the BOT Law. Response to your request While our aim is to provide information whenever possible, we are unable to provide your request as the PPP Center has no such draft proposal at the moment. We are working with the National Economic and Development Authority (NEDA) Board Committee on Infrastructure (INFRACOM) for the development of the Executive Branch’s proposed reforms to Republic Act (R.A.) No. 6957, as amended by R.A. No. 7718, otherwise known as the amended Build-operate-and-transfer (BOT) Law. However, we are unable to provide you with a copy of the INFRACOM’s proposed reforms as it is yet to finalize the same. As it is not yet finalized, it falls under information covered by Executive privilege , as defined under the Office of the President – Office of the Executive Secretary Memorandum on Inventory of Exceptions to Executive Order No. 2 (s. 2016), dated November 24, 2016. The Infrastructure Staff of NEDA, which serves as the INFRACOM Secretariat, may be able to provide you with the information you need regarding the Executive Branch’s proposed reforms to the BOT Law.
