Good day!

I would like to request a copy of the Power Supply Agreement for the Caliraya-Botocan-Kalayaan Power Plant complex, or any similar document that shows the energy offtakers of the power plant's 728 MW capacity. 

We are creating project briefs and analyses of the energy assets that are up for privatization and we wish to have this data to beef up our reports.

Greetings!

Thank you for your request dated November 06, 2020 05:21:30 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

While our aim is to provide information whenever possible, in this instance this Office cannot provide you the information you have requested for now since the Power Purchase Agreement between NPC and CBK has “Confidentiality Clause”.  Under its Article 3.7, both parties are prohibited to disclose information and documents (whether financial, technical or otherwise) to any other person, other than its representatives and consultants without the prior written approval of the other party. 

NPC will have to seek clearance/approval from CBK before we can provide you the information you requested.  Once we received the reply from CBK, we will inform you of the result.

While our aim is to provide information whenever possible, in this instance this Office cannot provide you the information you have requested at this time because the Power Purchase Agreement between NPC and CBK has “Confidentiality Clause”.
