November 15, 2019 Dear Radney Rigor, Greetings! Thank you for your request dated Nov 13, 2019 09:31:28 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Past Board Resolution/Ruling executed by the BOI Board Disallowing Special Class BPOs. Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. The BOI Board did not issue any resolution/ruling that bars 100%-export special class BPOs duly-licensed by PAGCOR from applying BOI incentives. XV of the General Policies of BOI Memorandum Circular No. 2017-004 (Subject: General Policies and Specific Guidelines to Implement the 2017 Investment Priorities Plan) provides the following: XV. Public Welfare Consideration The BOI may deny applications for registration and/or grant of incentives for reasons of national interest, public health, morals or for environmental considerations. Thus, any project that is against national interest, public health, morals or for environmental consideration, BOI may deny the said application for registration and/or grant of incentives.
