Hi! I would like to know the number of overstaying prisoners in the Bureau of Corrections that PAO has helped. That can be in the form of a number of petitions for habeas corpus that PAO has filed vs BuCor or number of administrative cases filed to recompute sentences for the convicts. It could be current data or data overtime. Thanks! Lian

December 6, 2022 Dear Lian Buan, Greetings! Thank you for your request dated Nov 15, 2022 11:57:58 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Number of overstaying prisoners in BuCor. Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. At present, our recording system can only provide data on the general categories of cases handled by the Office (i.e. criminal, civil, administrative, labor, and prosecutor's office cases), and on certain types of clients/cases (VAWC, OFW, Anti-trafficking, among others). Unfortunately, habeas corpus and administrative cases relating to computation of sentence are not specifically identified and segregated in our office records. Do note, however, that we started monitoring the number of released persons deprived of liberty assisted by the Office starting in March 2020. This data is included in our annual accomplishment report, which is accessible at https://pao.gov.ph/page.php?id=223 For further assistance you may review the FAQ section of the eFOI site: https://zcwdv320190208-dot-efoi-ph.appspot.com/help. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Honorable Chief Public Attorney Dr. Persida V. Rueda-Acosta, DSD at 5th Floor, DOJ Agencies Building, NIA Road corner East Avenue, Diliman, Quezon City. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011). Thank you. Respectfully, PAO-FOSS-DM PAO FOI Officer
