Greetings!
Thank you for your request dated Jun 26, 2021 03:17:36 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
Your Request
You asked for Number of cases filed with the IC; Average resolution time of cases.
Response to Request
This refers to your request for information on the following: (1) number of cases filed with the Insurance Commission (IC); and, (2) the dates of filing and resolution of cases. If item 2 is not available, you are instead requesting information on the average resolution time of cases.
We noted that you submitted a clarification that your request pertains not only to claims but to all types disputes submitted for resolution by IC.
With these, please be informed of the following:
1. On Administrative Cases.
Based on the available records of the IC Regulation, Enforcement and Prosecution Division (REPD), at present, there are 594 administrative cases that have been filed since1987. For the requested period of 2010 up to present, there are 168 cases filed, 53 of which are on-going cases at varying stages, 12 of which were archived, and the remainder were either dismissed or settled.
The average turn-around time for the resolution of administrative cases (garnered from date of filing of the complaint up to the date of a decision or resolution of a filed motion for consideration with the division) is about two (2) years, with the soonest resolved case, by way of settlement, that lasted for two (2) months; while the longest resolved case (discounting on-going cases) went on for seven (7) years.
Please note that the turn-around time varies from one case to another depending on the pleadings or motions filed, matters raised by parties, and complexity of the issues to be resolved in each case.
2. On Claims Cases for Resolution
Relative to the formal claims cases for resolution, the agency sent a letter dated 15 July 2021 through its Claims Adjudication Division (CAD) signed by Atty. Alwyn Franz P. Villaruel, citing the need for extension of period to respond to the request, as it necessitates examination of voluminous records of the agency (copy attached).
Your right to request a review
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by email at [email protected]. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.
If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
