Good day, May if the company is mandated / required to shoulder any medical expenses if an employee encounters a non-work related injury or illness while staying in company-provided accommodation or safehouse?

March 25, 2022 Dear Mariano Halog III, Thank you for your request dated Mar 10, 2022 01:09:00 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Non-Work-Related Accident in the Company-provided Accommodation. May we refer you to ECC BOARD RESOLUTION NO. 12-01-02 Declaring the Compensability of Injuries and its Resulting Disability or Death Sustained by Stay-in Local Employees within the Quarters Furnished by the Employers This Commission has declared the compensability of injuries, and its resulting disability or death, sustained by stay-in local employees in their quarters regardless of the time of its occurrence except when the disability or death was occasioned by the employee's intoxication, willful intention to injure or kill himself or another, or notorious negligence as provided under Article 172 ofP.D. No. 626, as amended. May we reiterate that the medical evaluators of the System shall be the one who will determine if the incident is work-related or not. As for whether the company shall be compelled to provide monetary assistance to the employee or not shall be determined by courts if a case shall be filed regarding the incident. Thank you.
