We bought a land residential lot last July/August 2018 at San Pedro, Puerto Princesa, Palawan for installment (20 years). We found out that there are illegal settlers there (former owner’s caretaker). It’s been five years since we’re trying to convince them to leave. Now, we have the Certificate to File Action from Brgy San Pedro and have consulted a private lawyer to file a case to court, recovery of ownership. However, the title is still under HDMF. Our lawyer is unable to proceed without the SPA from Pag Ibig and ALL the documents related to the lot. Can HDMF help us on this matter?
I’ve been trying to send email to Calamba Laguna HBC but no response. We are given 2 options by the lawyer: 1) Pag Ibig to initiate the complaint since the title is still under their name 2) Pag Ibig to provide ALL DOCUMENTATIONS and SPA to me as we file a “recovery of ownership” case to court. Documentations needed, but not limited to, 1) SPA to me and my lawyer 2) Copy of intention request letter sent by the illegal settlers to Pag Ibig 3) Copy of Pag Ibig response to that letter 4) History of TCT 5) Latest Tax Decs 6) Loan documents of previous owner 7) All documents related to the TCT number

AYUNGON, This refers to your eFOI request received on 26 April 2023 sent via the eFOI portal of the Home Development Mutual Fund (Fund) wherein you sought assistance regarding your concern on the illegal settlers in your purchased lot (in San Pedro, Puerto Princesa, Palawan) but cannot file a case in court as the title is still with the Fund. Kindly be informed that Section 3 of Executive Order No. 2, series of 2016 (Executive Order) grants every Filipino citizen the right to access information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development. In accordance with the aforementioned Executive Order, the Pag-IBIG Fund People’s Freedom of Information Manual (Manual) also states that “Information for Disclosure” includes: information promoting the awareness and understanding of policies, programs, activities, rules or regulations affecting the public, government agencies, and the community and economy (Section 2 of the Manual). Considering that you did not request for any information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development, we are constrained to deny your request. Nevertheless, we took the liberty of endorsing your concern to the operating unit concerned – the Loans Management and Recovery Department of Calamba Business Hub. As of this writing, Mr. Alexses P.
