Hi. Can NEECO 1 be sued for just compensation if there's an instance that it constructed an electric lines/posts to any private property because according to PD269, one of its power is eminent domain? And should we implead NEA too? Legal basis.

Hi. This is a follow up message. Can NEECO 1 be sued for just compensation in view of its occupation of a private property without the consent of the owners thereof? Said occupation was made under its eminent domain power under PD 629.

Thank you for your request dated Sep 09, 2023 12:15:23 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for NEECO 1 - JUST COMPENSATION. Yes, you can sue NEECO I for just compensation. However, NEA cannot be impede because NEECO I is a private entity and NEA is only supervisory agency to all electric cooperatives pursuant to Presidential Decree No. 269, as amended by Republic Act No. 10531. Your FOI request is approved. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the NEA Administrator at [email protected]. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011). Thank you.
