March 25, 2022 Dear Mariano Halog III, Thank you for your request dated Mar 10, 2022 01:27:01 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Maximum allowed overtime. Employees covered by the Labor Code of the Philippines are entitled for Overtime pay, The law does not provide for maximum allowable hours for overtime. But generally speaking, the number of OT hours varies depending on the situation and type of industry. Section 10 of Book III of Omnibus Rules of the LCP outlined the different instances when employees may be compelled to perform overtime work with premium pay. For the DOLE, it has issued various policies pertaining to OT, employees may render as: 1. Department Order 118-12, series of January 2012, is also known as the “Rules and Regulations Governing the Employment and Working Conditions of Drivers and Conductors in the PUB Transport Industry pegged the maximum work of bus drivers to 12 hours which allows 4 hours OT (8 hours plus 4 hours = 12 hours), 2. For health care workers, in exigency of service may be asked to worked for 16 hours to cover for their absent co-employee, 3. DOLE FDCP Joint Memorandum Circular (JMC) No. 1, Series of 2020 Guidelines on Working Conditions for workers in the Audio Visual Industry, the maximum number of work hours per day shall be 16 hours with at least 12 hours turn around time between days. In a nutshell, while there is NO hard and fast rule in determining the maximum number of overtime work an employee may render; the type of work being performed, as well as the result of the conduct of Hazard Identification Risks and Control are important determinants in setting the maximum number of OT hours per Industry.
