Good day po! I am Laurence D. Cerado, a BS Nutrition student from UPLB, currently taking up the course HNF 200 or Undergraduate Thesis in the field of Human Nutrition and Food. My study needs respondents from students enrolled in purely online universities. In connection to my data collection procedure, may I humbly ask your good office if I may have the list of undergraduate students in PUPOU enrolled in the 1st Sem A.Y. 22-23? March 28, 2023 Dear Laurence, Greetings! Thank you for your request dated Mar 09, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for List of Undergraduate Students in PUP OU in 1st Sem AY 2022-2023. Response to your request While our aim is to provide information whenever possible, in this instance this Office cannot provide you the information you have requested as it violates the Data Privacy Act. Under the Data Privacy Act of 2012 , the processing of personal information is considered lawful when any of the conditions set forth in Section 12 and 13 thereof are met. Personal information refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual. The processing of personal information shall be allowed, subject to compliance with the requirements of the DPA and other laws allowing disclosure of information to the public, and adherence to the principles of transparence, legitimate purpose, and proportionality. The processing of the information you are requesting will be allowed under the DPA provided the consent of the students are acquired. Also, in accordance with the principle of accountability, the University, as an educational institution is accountable for all the personal data it collects and processes, even if if the same outsources thereof to a third party. Therefore, this Office humbly opines that the consent of the data subjects, or the students in the instant query, must be first obtained prior to the processing of personal information. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Vice President Pascualito B. Gatan at [email protected]. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011). Thank you.
