June 15, 2022 Dear Mr. Carvajal, Greetings! Thank you for your request dated May 27, 2022 11:13:30 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Particularly, you are requesting for an updated list of Politically Exposed Persons (PEPs) from the Anti-Money Laundering Council (AMLC) for purposes of updating the PEP List in the Remittance System of your company, KABAYAN International Ltd in Japan. Rule 2, Section 1 (zzz) of the 2018 Implementing Rules and Regulations (2018 IRR) of Republic Act No. 9160, otherwise known as The Anti-Money Laundering Act of 2001, as amended (AMLA) defines a Politically-Exposed Person (PEP) as “an individual who is or has been entrusted with prominent public position in (a) the Philippines with substantial authority over policy, operations or the use or allocation of government-owned resources; (b) a foreign state; or (c) an international organization”. The 2018 IRR also requires covered persons to conduct enhanced due diligence and implement risk management system to detect PEPs. Based on the foregoing, the AMLC has provided the definition of PEPs to guide covered persons in identifying those who are considered as such. However, the AMLC does not maintain a database of PEPs. In view thereof and considering that the information requested pertains to a consolidated list of officials in the Government covering both the National Government and the Local Government Unit, the Department of Interior and Local Government (DILG) and the Department of Budget and Management (DBM) are in better position to provide the appropriate list.
