October 18, 2021 Dear Jorge Apura Jr, Thank you for your request dated Oct 16, 2021 08:31:36 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Labor Law Provision on Contract of Employment. As a general rule issuing employment contract is not required under Philippine laws. However, it is still highly encouraged that it is still be issued for the following reasons: 1. To set proper expectations with the workers. 2. To generate evidence that they are aware of the job requirements. 3. To document workers progression within the company for records purposes (as basis for retirement and separation pay/tenure). 4. To dispute claims as being an organic employee. Without this employment contract, it may be presumed that the worker is a regular employee of the company. By way of exception, DOLE DO 174 s. 2017 requires that contractors and sub-contractors to provide for a written contract to their deployed personnel. Thank you.
