July 12, 2023 Dear Mr. Villlarasco: I refer to my letter of Jul 11, 2023 10:48:40 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR. In reply, please be informed that your request for a copies of your Income Tax Return and/or BIR Form No. 2316 can be obtained through your EMPLOYER as they are obligated to furnish every employee a copy of the aforesaid form as a proof of taxes withheld which shall serve as an Annual Income Tax Return (AITR) of the employee according to Revenue Regulation 2-98, as amended The employer shall prepare BIR Form No. 2316 in triplicate, which shall be distributed as follows: (1) Original – Employee’s copy; (2) Duplicate – BIR’s copy; and (3) Triplicate- Employer’s copy which shall be retained for a period of ten (10) years.” Please coordinate with your employers and ask for the copy of your BIR Form 2316 from the Calendar Years 2021 to 2022 if you have not receive a copy. What the Revenue District Office (RDO) has in their records are copies of BIR Form No. 2316 from CY 2020 to 2022. Please provide us your previous Employer Company Name and their Tax Identification Number (TIN) for verification. The BIR Form No. 2316 for Calendar Year 2023 has not yet been submitted by your Employer in the Revenue District Office (RDO) because the taxable period has not yet elapsed/finished. The RDO gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2024. During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 04, 2023 07:36:12 AM, your request will be closed.
