Hi. I would like to know where can we check if our barangay officials(Brgy. Sta. Rosa 1, Noveleta, Cavite) have filed their income tax returns (ITR) and statements of assets, liabilities, and net worth (SALN) accurately and timely? We have noticed the increase in lifestyle (house built, business owned) by our Punong Barangay but we are not aware of her income source except being a Punong Barangay. Thank you
December 12, 2022 Dear Ms. Cruz: Greetings! Thank you for your request dated Dec 09, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for a copy of the Income Tax Return and/or BIR Form 2316 and SALN of Barangay Officials. Response to your request In response to your request, while our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as this is not under our office jurisdiction. The Statement of Assets, Liabilities and Net Worth (SALN) shall be submitted to the Civil Service Commission (CSC) and Office of the Ombudsman, Central Office through the Local Government Unit (LGU) - Human Resource Management Division (HRMD). The submission of a SALN is required by law under Article XI Section 17 of the 1987 Constitution and Section 8 of Republic Act No. 6713, the "Code of Conduct and Ethical Standards for Public Officials and Employees". As to the filing of their respective Income Tax Return and/or BIR Form 2316 as Barangay Official of Noveleta Cavite. Please be informed that BIR Form 2316 must be accomplished by an EMPLOYER for each EMPLOYEE receiving salaries, wages, and other forms of remuneration, indicating the total amount paid and the taxes withheld for the calendar year. It must be issued to the employee on or before Jan. 31 of the succeeding year, or on the day of last payment of wages in case of termination from employment. This certificate, will serve as their Income Tax Return (ITR) being an employee earning purely compensation income regardless of the amount. You are qualified to “Substituted Filing” of ITR pursuant to Revenue Regulation (RR) No. 2-98 as amended. The same shall be submitted to the Revenue District Office (RDO) having jurisdiction over the place of their respective employer. For your information and guidance. Thank you.
