Just want to ask if a 5th class municipality will be allowed to create a position with SG-16? And Will it violate the provisions in the Local Government Code?

Dear Ariane Jane Gerelingo,
This refers to your inquiry on whether a 5th class municipality may be allowed to create a position allocated to Salary Grade-(SG)16.
Under Item 9.2.1.5 of the Manual on Position Classification and Compensation, circularized under DBM Circular Letter no. 2007-6, the highest position below the Assistant Department Head position that may be created in a 4th to 6th class municipality should be allocated to SG-14 to SG-16.
Should you require further clarification on the matter, you may seek the assistance of the DBM Regional Office nearest your vicinity.
