Hi I would like to request information regarding HMO.
May company promised upon hiring that they will provide HMO benefit only after 1 yr of employment. I was hired April 1, 2022. 1 yr & 4mo. have passed, I followed up the awarding of HMO but HR told me that it was not possible anymore. Can this be grounds for complaint? I sometimes go for field work and very busy with my office and I think health & safety should be top priority in my line of work.

Thank you for your request dated Aug 31, 2023 11:01:00 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
You asked for HMO Query.
As a general rule, the law does not require companies to provide their employees with HMO. Any practice of providing free health cards to workers is part of good company practice.
Nonetheless, if this practice has ripened to benefits or has become a norm to the Office, it may still be subject to complaint as this may be interpreted as diminution of benefits which is prohibited under Article 100 of the Labor Code of the Philippines.
However, we strongly advise that the matter be resolved first by the company's grievance committee prior to its elevation to the DOLE's Regional/Field Office having jurisdiction over the workplace.
