Dear Mr. Jus Mango:
Thank you for your request dated 18 October 2021 under Executive Order No. 2 (S. 2016) on Freedom of Information in the Executive Branch.
Your request is:
“I would like to report the harassment of the online lending app name Honey Loan, with death treat.”
In this regard, please be advised that the acts complained of are not considered predicate offenses to money laundering, hence outside the scope of the AMLA. Please be informed, however, that victims of unfair debt collection practices and cyber harassments may institute the necessary actions against the online lending companies to the following offices:
(1) before the National Privacy Commission (NPC), for violations of R.A. No. 10173, or the Data Privacy Act of 2012;
(2) before the Office of the Prosecutor, the National Bureau of Investigation, or the Philippine National Police, for violations of R.A. No. 10175 and the Revised Penal Code; and
(3) before the Securities and Exchange Commission, if the act is committed by a lending or financing company.
