Good day,
I would like to know the guidelines on managing solicited and unsolicited proposals and it's procedures as approved by IATF during this pandemic and still mandated under BOT law.
Also, if the procedure of submitting a proposal whether is a solicited or unsolicited, through online?
If the negotiation process is still on video conference, will there be an online procurement process during the Swiss Challenge with video conferencing?

Response to your request
Your FOI request is approved. We answer your request as follows:
1. The Public Private Partnership (PPP) Center acknowledges that the Inter-agency Task Force for Emerging Infectious Diseases (IATF-EID) released several resolutions for the management of the COVID-19 pandemic. However, we are not aware of any IATF-EID guidelines on the management of PPPs during the pandemic. Hence, the procedures for both Solicited Projects and Unsolicited Proposals under Republic Act (RA) No. 6957, as amended by RA No. 7718, or the Build-Operate-and-Transfer (BOT) Law, and its Implementing Rules and Regulations (IRR), are still applicable.
2. As discussed above, the procedures are laid down under the BOT Law and its IRR. Furthermore, the Pre-qualifications, Bids, and Awards Committee (PBAC) of the concerned Implementing Agency is required to issue the instructions on the process of bid submissions for ongoing PPP tenders, including bid bulletins for any changes thereto.
We suggest direct coordination with the concerned Implementing Agency on their preferred mode of receipt of the submission.
3. Similar to item 2 above, we suggest direct coordination with the concerned Implementing Agency for the instructions during the Swiss Challenge.
