You asked for Freeport Zone.
Response to Request
Foremost, we apologize for the inconvenience for we just recently (last week) restored access to the eFOI portal.
Your FOI request is approved. Please find hereunder the information you requested.
1) On "Kindly confirm if Clark is also a Freeport Zone?"
Republic Act No. 9400 series of 2007 declared that 4,400 hectares of the Clark Main Zone (former Clark Air Base proper) be designated as a Freeport Zone.
2) On the questions, "Does it mean that all the items will be exempted from import duties? Is there a requirement for the tax exemption on imported items?"
- If an enterprise (after meeting the requirements of Clark Development Corporation or CDC, e.g. required investment amount, number of employees, etc.) was granted tax- and duty-free importation privilege through the issuance of a Certificate of Registration and Tax Exemption (CRTE), all of its capital equipment and raw materials may be imported tax- and duty-free. Provided, however, that these goods/articles are necessary and directly related to its approved business activity/ies (as stated in the enterprise's issued CRTE).
3) On the question, "Do you have a list of non-taxable imported items?"
- None. The approved business activity/ies of an enterprise shall be the basis of CDC in approving or denying an enterprise's application for tax- and duty-free importation of a particular good/article.
