This is an Appeal/Request for review, and your department have now been emailed a Court Order from RTC Branch 66 Talisay City that was made against the Executive Branch of Government, Ordering the information I have requested, which under Executive Order No.2 over-rides any Exemption. Any refusal is Corruption under RA3019 Section 3 (f) Neglecting or refusing, after due demand or request, without sufficient justification xxx
While we aim to provide information whenever possible, in this instance upon final evaluation and review of your request, be advised that personal transactions cannot be interposed. The Freedom of Information (FOI) provides that “exceptions to the right of access to information” include the following: Item 3. iv. – “Information concerning law enforcement and protection of public and personal safety: unjustifiably disclose investigative techniques and procedures”; and Item 4: “Information deemed confidential for the protection of the privacy of persons and certain individuals such as minors, victims of crimes, or the accused.” We concur with the decision of the Department of Justice that such requests, especially on-going court proceedings are recognized in international law as restricted and treated as confidential and privileged, and are as well included in the Inventory of Exceptions to Executive Order No. 2, the Order which operationalized the right to information and is constrained by law to be issued copies of the subject documents to the public.
