Good day! My request with Tracking #DOF-909987886106 was denied by Dept of Finance and referred me to DFA instead. I have searched the internet however there is no copy of signed Exchange of Notes between Japan and Philippines even for the past Agreements, however turns out none. Based on Court Decision G.R. No. 175772, I would like to know the clauses pertaining to the Taxation of National Government Projects especially ODA and JICA funded projects and if applicable to recent projects such as NSCR Extension Project. Your request You asked for the Exchange of Notes for the 109-kilometer North-South Commuter Railway (NSCR) Extension Project. Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. Your request pertains to a loan agreement. Memorandum Circular No. 16, series of 2017, directs all departments to coordinate with the Department of Finance (DOF) on matters pertaining to loans, grants and guarantees. Upon evaluation of your request, bearing in mind that the DOF is the repository of all loan agreements, permission to access the subject loan agreement must, therefore, be obtained from the DOF. Considering that the DOF has already denied your previous request, the DFA is constrained from approving this request.
