March 13, 2023 Sir: Greetings! Thank you for your request dated Mar 10, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Estate Tax Payment in BIR. Response to your request Yes, the subject property with liens and encumbrances may be the subject of estate tax settlement. The new title and other titles to be issued as a result of the settlement of the estate tax will bear the same liens and encumbrances until the same has been settled and the entry in the title has been cancelled by the register of deeds. Sir/Maam: With regards to your reply dated March 13, 2023, I would also like to know, is there any additional or miscellaneous fees that we need to pay when paying the estate tax of a title with liens and encumbrances? This question was escalated when we are asked by the BIR Officer to pay "other miscellaneous fees" when we tried to settle the estate tax of the title with liens and encumbrances. That's why, we are asking this agency if that's is legal or illegal. Thank you.
