May we request for the following contracts of the LRT Line 1 extension project:
1. Engineering, procurement and construction (EPC) contract, and
2. Operation and Maintenance (O&M) contract.

Dear Ma'am Karen,
We would like to inquire about the status of our request last July 30, 2018 for the following documents on LRT 1:
1. Engineering, Procurement and Construction contract, and
2. Operation and Maintenance contract

Your request is denied due to the requested documents fall under the inventory of exceptions as stipulated in the Section 4 of E.O. No. 2 (s. 2016).

Specifically, the exception is under 5a, which states, “Information. Documents or record known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards, or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers, such as but not limited to the following:
a.	Trade secrets, intellectual property, business, commercial, financial and other proprietary information;”

Per Concession Agreement, the operations and maintenance of LRT 1 is under the management of Light Rail Manila Corporation (LRMC), which is a joint venture company of Metro Pacific Investments Corporation’s Metro Pacific Light Rail Corporation (MPLRC), Ayala Corporation’s AC Infrastructure Holdings Corporation (AC Infra), and the Philippine Investment Alliance for Infrastructure’s Macquarie Infrastructure Holdings (Philippines) PTE Ltd. (MIHPL). 

Per LRMC, the EPC and O&M contracts are considered sensitive commercial documents, thus, they cannot share them.
