Hi Good evening po ako nga po pla si Edilberto Nacion dating empleyado ng Heal The World Energy Saving Corporation. Tinanggal po ako sa trabaho ko at ako nag file ng kaso sa Korte ngayon po ang hatol ng korte ay reinstate po ako at my entry of judgement na po sa court of appeals. Ang abugado ko po sa PAO ay pinapatanong po sa akin sa Company kong ano na po ba daw employment status ko kong na reinstate na po ba. Pinapakuha po ako ng copy nito. Kaso po nandito po ako ngayon abroad OFW po ako. Nakikiusap po sana ako sa pamunuan ng DOLE na matulungan po ako mka kuha copu sa Company thank you po.

May 25, 2023 Dear Edilberto Nacion, Thank you for your request dated May 17, 2023 08:57:13 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Employment Status of Reinstatement. It is with regret that we cannot grant your request. The DOLE is not a party to the case, thus we do not have any legal personality to request the status of the court's order. We advise you to issue a Special Power of Attorney to your PAO lawyer and allow him/her to act on your behalf. As per your narration, you are currently working abroad. If there will be a difficulty on your part to return to your previous work; An alternative you may explore is to ask for a separation pay under the doctrine of strained relations. The doctrine relates that the payment of separation pay of at least one month of pay per year of service shall apply. Under the doctrine of strained relations, the payment of separation pay is considered an acceptable alternative when the option of reinstatement is no longer viable or desirable.
