May we know please how many companies are using 365 as a divisor for monthly paid scheme? And how about other divisor such as 261, 313, 287 or any other divisor for that matter? Would you happen to have this information? If not, would you be kind enough to refer us to related Government agency who may be able to assist? Thank you.

January 28, 2019 Dear Laarni Lanzarrote, Greetings! Thank you for your request dated Jan 10, 2019 12:21:05 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for the divisor factor to determine daily wage of monthly paid workers. Likewise, in your message, you requested statistics on the number of companies using 365 as a divisor for monthly paid scheme and other divisors. First, please be informed that setting the factor for the computation of the monthly salary or the equivalent estimated monthly rate (EEMR) for daily-paid workers being paid on equal/average monthly rate, is a prerogative of the management. The company may adopt several factors or they may use the daily-paid wage system (based on the actual number days worked) according to group or classification of positions or other factors/criteria. To determine the daily wage of monthly-paid workers using the factor 365, we use the formula: Daily Wage = Monthly Rate X 12 ÷ 365. If using factors other than 365, we simply change 365 by the factor being used, such as Daily Wage = EEMR X 12 ÷ 313. During inspection, the factor being used may be asked by the Labor Inspector for the purpose of determining if the company is complying with the minimum wage law, but it is not mandatory company information collected during the process.
