While the Department fully supports the National Government's decentralization policy, we are constrained to deny your request under Section 6 (b) of Office of the President Memorandum Circular No. 89, which exempts from the right to access to information such information which a premature disclosure would be likely to frustrate the implementation of a proposed official action. Moving forward, the DOE is taking necessary actions to ensure that we are consistently on the right track in implementing Executive Order (EO) 138. Nevertheless, we believe that the preparation of the Department's Devolution Transition Plan will procees through a comprehensive review of all pertinent Government directives and be guided by harmonizing existing energy laws and policies. If you are unhappy with our response to your FOI request, you may ask us to carry out an internal review by writing a letter or email addressed to Secretary Raphael P.M.
