October 3, 2021 Dear Mariano Halog III, Thank you for your request dated Sep 30, 2021 12:08:24 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Department order on maximum allowed overtime in construction industry. May we refer you to DOLE DO 13 s. 1998 otherwise known as the "Guidelines Governing Occupational Safety and Health in the Construction Industry", with emphasis given to the requirement for an COSH Program prior to the start of the project. Such COSH Program shall also include the allowable maximum overtime of the workers in the project. As mentioned in the DO, the overtime that may be rendered is subject to the overriding safety and operational conditions of the project. This is best determined by an expert (COSH Practitioner or Consultant) in their conduct of HIRAC. The physical exhaustion as caused by manual labor should be the primary consideration for determining the allowable maximum overtime. Fatigue is one of the known causes of accidents in any workplace including that of construction. Further, allow us to share with you that compliance to the law should NOT be the paramount consideration in the implementation of OSH Programs as standards are just minimum requirements prescribed by law. The health and safety of workers should be above what is prescribed by laws. This shall mean that in its absence or if there is an ambiguity, establishments may go beyond to what is prescribed.
