Greetings!

Thank you for your request dated Jun 27, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Copy of Income Tax Return and/or BIR Form No. 2316.

Response to your request

In reply, please be informed that your request is hereby denied due to the following reasons:

1. For every eFOI request, scanned copies of at least two (2) valid government I.D.s containing the photograph and signature of the requesting party must be attached per Section 21.3, Chapter VII-Standard Procedures for eFOI Requests of the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue; and

2. If you are employed for the Calendar Year 2022 to 2023, your request can be obtained through your EMPLOYER as they are obligated to furnish their employees' a copy of the BIR Form No. 2316 as a proof of taxes withheld which shall serve as an Annual Income Tax Return (AITR) of the latter according to Revenue Regulation 2-98, as amended.

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022 to 2023 (BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID).
