Thank you for your request dated November 16, 2020 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. 

Your request 

You requested for a copy of the Concession Agreement executed between MWM Terminal, Inc. and the Department of Transportation for the PITX Project.

Response to your request 

While our aim is to provide information whenever possible, in this instance, the Public-Private Partnership (PPP) Center is unable to provide the information you have requested because under the Department of Justice (DOJ) Opinion No. 26, s. 2017, the DOJ opined that it is the implementing agency (IA), and not the PPP Center, that should decide which part of the PPP Contract can be published/shared publicly and which section therein contains classified or privileged information that should remain confidential.

We recommend that you request the said information with the IA, the Department of Transportation (DOTr). You may contact DOTr-FOI Receiving Officer Kriscia Mallari through telephone number 790-8300 local 305/723, or e-mail address [email protected]. 


Your right to request a review 

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Office of the Executive Director. Your review request should explain why you are dissatisfied with this response, and should be made within 15 working days from the date you received this letter. We will complete the review and tell you the result within 30 working days from the date we receive your review request. 

If you are not satisfied with result of the review, you then have the right to appeal to the Office of the Secretary of the National Economic and Development Authority and thereafter, to the Office of the President pursuant to Administrative Order No. 22 (s. 2011).
