Hello, Good day! We are writing to you to request for information regarding the past violations/non-compliance to the Republic Act No. 11058/DOLE DO 198-18. Would it be possible to share with us the list of violations and companies who have been penalized (if any) covering the period Jan 2022 - Dec 2022. If you could share with us at least the company's nature of business (e.g. construction, manufacturing, etc.) The data is to be used by my company for the research project and implementation of our Occupational Safety & Health programs and policies.

March 7, 2023 Dear Kelvin Nestly Cusipag, Thank you for your request dated Mar 06, 2023 09:36:47 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for Companies Penalized due to non-compliance to RA11058/DO 198-18. It is with regret that we cannot not provide you with the names of companies being penalized for OSHS violations. The Data Privacy Act of 2012 restricts us to do so. Nonetheless, we will provide you with the top 10 violations and types of industries inspected by us last year. The DOLE has inspected 81,314 establishments last year with top 10 OSHS violations. 1. No first aider 2. No safety officer 3. No fire safety inspection certificate 4. Non registration under Rule 1020 of OSHS 5. Non formulation of OSH Program 6. Non submission of AMR 7. Non submission of WAIR 8. Failure to conduct OSH Orientation to workers 9. Non submission of Report on Safety and Health Organization 10. No OH Programs for workplace TB/HIV AIDS/Hepatitis B. Majority of establishments inspected were the following: 1. Wholesale and retail trade 2. Accommodation and Food Services 3. Administrative and Support Service Activities 4. Financial and Insurance Activities 5.
