Hi, I would like to know some details about child support. If the biological mother of the kids demands child support from the biological father, how much is the monthly/weekly support that the father is required to provide, in monetary, or in goods, or both monetary and goods? Suppose the ages of the kids are below 8 years old. Thanks! Geiane

12 October 2020 Dear Mr. Geiane Clyde Cayasan, Greetings! Thank you for your request dated 5 October 2020 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You requested information on the following: (1) Details about child support. If the biological mother of the kids demands child support from the biological father, how much is the monthly/weekly support that the father is required to provide, in monetary, or in goods, or both monetary and goods? Suppose the ages of the kids are below 8 years old. Response to your request Unfortunately, the DSWD does not have the information you need. Thus, we are constrained to deny your request. According to Article 194 of the Family Code, support comprises everything indispensable for sustenance, dwelling, clothing, medical attendance, education and transportation, in keeping with the financial capacity of the family. While the biological father can voluntarily give money and goods to the mother of his biological children to support the same, only in a proper case for child custody and support will the court order the biological father to give a fixed amount monthly to give to the mother of his biological children to support them. Thus, we can’t answer your hypothetical questions because only the court can fix the amount based upon the financial capacity of the person obliged by the court to give support. Further, you can ask the Public Attorney’s Office (PAO) for assistance regarding your request. Thank you. Respectfully, Atty. Sittie Raifah M. Pamaloy-Hassan FOI Decision Maker
