May 9, 2023 Dear Clienth Cajegas, Greetings! Thank you for your request dated May 08, 2023 10:26:00 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Certificate of compliance. Response to your request Greetings! This pertains to your letter, received through the Freedom Of Information (FOI) Portal on May 8, 2023, whereby you requested for the following documents for your WEM Accreditation Application: 1. Valid DOLE Certificate of Compliance to General Labor Standards (GLS); 2. Valid DOLE Certificate of Compliance to Occupational Safety and Heath Standards (OSHS); and 3. Valid DOLE Certificate of Compliance to Child Labor Laws and Regulations At the outset, please be informed that the DOLE Office recognizes the right of the people to information on matters of public concern. Access to official records, documents and information pertaining to official acts, transactions, or decisions, as well as government generated data/information and researches used as basis for policy development shall be afforded the public, but subject to such limitations as may be provided under RA 10173 otherwise known as the Data Privacy Act of 2012, and other pertinent laws and regulations. While the DOLE Regional Office is more than willing to share the list of requirements of the different programs of the Department, but under the existing rules and regulations the issuance of DOLE Certificate of Compliance is no longer implemented. For the information of the public, the issuance of DOLE Certificate of Compliance was implemented under DOLE Department Order No. 131- B, Series of 2016, otherwise known as the “Revised Rules on Labor Laws Compliance System”, which was however amended and/or repealed by DOLE Department Order No. 183 – 17, as early as November 2017. In addition, effective April 30, 2023, the prevailing rules and regulations on the Labor Inspection Program is now Department Order No. 238, Series of 2023, otherwise known as the “Rules On The Administration And Enforcement Of Labor Standards Pursuant To Article 128 Of The Labor Code Of The Philippines, As Renumbered, And Republic Act No. 11058”. As it stands, the issuance of DOLE Certificate of Compliance no longer exists based on our present program and guidelines and thus, the Regional Office can no longer provide you with requested details or list of requirements as it bears pointing out that any disclosure of information to the public is subject to existing rules and requirements provided by relevant laws and DOLE issuances on the matter. With the foregoing discussions, this Office hopes that it has provided you with appropriate guidance and clarified your concerns on the matter.
