Maari po ba ako maregular sa trabaho ko. almost 5yrs na po ako sa trabaho ko pero. palipat lipat lng ng kompanya ang ginagawa nila sakin at paulit ulit na pagpirma ng kontrata sa tuwing matatapos ako sa kontrata ko sa pagtatrabaho. dalawang kompanya po pero iisa lang mga employer ko sa trabaho.?

November 29, 2022 Dear Vincent Masigan, Thank you for your request dated Nov 06, 2022 02:27:40 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for CASUAL and REGULARIZATION. As a general rule as per Labor Code of the Philippines, if a worker have rendered 6 months of continuous contract with or w/o regularization notice, the worker will be automatically considered as regular employee of the company. However, that shall still depend on the employment arrangements. Contracting and sub-contracting arrangements, project based employment and other fixed term employment are exemptions. For issues of regularization, you may contact the nearest DOLE Regional or Field Office having jurisdiction to your company. You may request for a conciliation and mediation proceedings. This opinion was rendered based on the facts that you presented. Any information that are vital that were not presented may arise to a different opinion. Thank you.
